These Terms and Conditions govern the sale of digital courses and training plans on horsercize.com ("Website"). By purchasing any product from the Website, you agree to be bound by these Terms and Conditions. Please read them carefully before making a purchase. 

1. Company Information 

Horsercize is a self-employed business registered in Sweden under the name "TD EquiServices." 

2. Purchase of Digital Products 

2.1. Course Format 

All courses and training plans sold on the Website are provided in digital format, which may include video content, PDFs, and/or audio files. Customers will receive access to the purchased course materials through their account on the Website after payment is confirmed. 

2.2. Lifetime Access 

Upon purchase, you are granted lifetime access to the digital products, unless otherwise stated. Access will be available as long as horsercize continues to operate the Website. 

2.3. License to Use 

You are granted a non-exclusive, non-transferable license to access and use the course materials for personal educational purposes only. You are not permitted to share, distribute, reproduce, or resell any of the materials in any form. 

2.4. Unauthorized Use 

Sharing access credentials or allowing others to use your account is strictly prohibited. If unauthorized sharing is detected, you will receive a warning. Repeated violations may result in termination of your access without refund. If you believe the sharing was accidental or unintentional, you may contact our support team for clarification. 

3. Pricing and Payments 

3.1. Pricing 

All prices displayed on the Website are inclusive of applicable value-added tax (VAT). The price will be the same regardless of the buyer’s location, with VAT calculated based on the buyer’s country of residence (e.g., 25% MOMS in Sweden, 19% VAT in Germany). 

For example: 

  • Price in Sweden: $99 (including 25% MOMS) 

  • Price in Germany: $99 (including 19% VAT) 

The final purchase price, inclusive of VAT, will be clearly displayed at checkout, along with the applicable VAT rate for your country. 

3.2. Payment Processing 

Payments are processed via third-party platforms, including PayPal and Stripe, through Woocommerce. By making a purchase, you agree to the terms and conditions of the selected payment gateway. 

3.3. Currency 

Prices are displayed in USD for all customers, regardless of their location. Customers will be charged in USD, and any currency conversion fees or additional charges may apply depending on your payment provider or bank. Please consult your financial institution or payment provider for details regarding conversion rates and fees. 

4. Refunds and Cancellations 

4.1. Waiver of Right to Withdraw 

At checkout, you must tick a checkbox explicitly confirming your consent to waive your right to the 14-day cancellation period under EU consumer law. By doing so, you acknowledge that the content can be accessed immediately upon purchase, and you expressly waive your right to withdraw from the contract. This waiver must be confirmed before access to the course materials is granted. 

4.2. Limited Satisfaction Guarantee 

We are committed to providing high-quality content. If you are dissatisfied with the course materials, you may request a refund within 7 days of purchase, provided you have accessed no more than 20% of the course content. To help monitor this, each course will include a visible progress bar showing the percentage of the course content you have accessed. Refund requests must be submitted via support@horsercize.com. 

4.3. Technical Issues 

If you experience any technical difficulties accessing your purchased materials, please contact our support team at support@horsercize.com. We will work to resolve the issue or, if necessary, provide a refund. Common technical issues may include: 

  • Login Problems: Difficulty accessing your account or resetting your password. 

  • Video Playback Issues: Inability to play video content due to browser or internet connectivity issues. 

  • Download Problems: Inability to download PDFs or audio files. 

  • Compatibility Issues: Courses not functioning properly on specific devices or browsers. 

  • Audio/Visual Sync Issues: Delays or mismatches between video and audio content. 

A refund request due to technical issues must be submitted within 30 days of purchase. 

5. Intellectual Property 

All content, including but not limited to videos, PDFs, audio files, and other materials provided in the courses, remains the intellectual property of horsercize. No content may be copied, reproduced, distributed, or modified without express written consent. 

6. Disclaimers and Limitation of Liability 

6.1. Educational Purposes Only 

The courses offered by horsercize are for educational purposes only and do not replace professional advice from trainers or veterinarians. We recommend consulting with a professional trainer or veterinarian before engaging in any new training activities with your horse. By purchasing our courses, you agree to take full responsibility for your and your horse’s health and safety during any training exercises. 

6.2. Acknowledgment of Risk 

Horse training, riding, and related activities carry inherent risks. By using the course materials, you acknowledge these risks and agree to exercise caution when applying any training techniques. Always monitor your horse’s physical and mental well-being, and seek professional advice if unsure. Horsercize is not liable for any injuries, accidents, or damages that arise from following the course instructions, except in cases of gross negligence or willful misconduct. 

6.3. Limitation of Liability 

Horsercize shall not be liable for any injuries, accidents, or damages that may arise from following the instructions provided in the course materials, except in cases of gross negligence or willful misconduct. By purchasing and using our products, you acknowledge and agree to this waiver of liability. This waiver does not exclude liability for injuries caused by defective content, where applicable under Swedish or EU law. 

7. Disclaimers for Individual Courses 

Each course may have its own specific disclaimer outlining potential risks or limitations related to that particular course. 8. Governing Law and Jurisdiction 

These Terms and Conditions are governed by and construed in accordance with the laws of Sweden. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Sweden. 

If you are purchasing from another EU country, you may also have the right to bring a claim in your local jurisdiction under EU Regulation 1215/2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters. 

9. Product Descriptions and Expectations 

We aim to provide clear and accurate descriptions of all our digital products. If you believe the course materials do not meet the description provided on the Website, you may contact us for review. Claims regarding misrepresentation or unmet expectations must be made within 14 days of purchase and will be assessed on a case-by-case basis.
